In this taxpayers' action, Special Term has dismissed plaintiffs' amended complaint for failure to state a cause of action and on the further ground that a judgment based on a determination made by Mr. Justice MOORE in another taxpayer's action against the same defendants was res judicata and consequently a bar to the instant action.
