This matter came before the court upon the exceptions of the Union Commerce Bank as executor of the estate of Freeman A. Smith, deceased, to an order entered January 26, 1970, by the general referee that a certain transfer during decedent's lifetime was subject to the incidence of Ohio Inheritance Tax.
