Fred Junior Tyler, hereinafter referred to as defendant, was charged, tried and convicted in the District Court of Oklahoma County for the crime of Second Degree Burglary, After Former Conviction of a Felony. The punishment to be imposed was left to the court and the court set defendant's punishment at imprisonment in the state penitentiary for a term of twenty years.
