Appellant was tried in the 179th District Court for the offense of rape. On May 25, 1967, he was tried before a jury and was acquitted on the ground that he was insane at the time the crime was committed. The jury also found he was insane at the time of trial and that he should be hospitalized in a mental hospital for his own welfare and protection and the protection of others.
