Plaintiff, Frank W. Schultz, filed this suit to foreclose by executory process on a mortgage indebtedness affecting real property in Rapides Parish. The suit was instituted against Eugene Robinson, the mortgagor and maker of the note secured by that mortgage. Robinson filed a petition in the same suit praying for judgment enjoining the sale of the property. And, in that proceeding judgment was rendered by the trial court in favor of Robinson, granting...
