The action as originally pleaded was to recover the amount of a fire loss pursuant to policies of insurance. While the proposed amendment of the complaint might be considered as changing the legal theory supporting the amount demanded in the original complaint, it does not appear that the original basis of the cause of action has varied insofar as the foundation therefor was proceeds of the insurance policies.
