Plaintiff appeals from an order which dismissed a second cause of action in the complaint which alleged the violation of section 65 of the Public Service Law purportedly making the defendant absolutely liable without regard to its care or lack of it. The first cause of action not appealed was premised in negligence seeking property damage from the defendant.
