Defendant was charged with a murder committed while engaged in an attempted robbery on March 4, 1969, at a plastics factory in East Farmingdale. In opening to the jury, the prosecutor stated that he was going to produce a witness "to show you that he was in on the planning of this [the robbery] but [he] didn't go.
