In this appeal we are confronted with several problems involving the law of contracts. The plaintiff appeals from the action of the circuit court by which a verdict in his favor in the amount of $14,197.50 was set aside upon the defendant's motion for judgment n. o. v.; a judgment was entered dismissing the plaintiff's claim; $2,697.50 had been paid by the defendant on a confessed judgment.
