This is an appeal from a denial of a motion to vacate a sentence pursuant to 28 U.S.C. § 2255 by the District Court for the Middle District of Georgia. We reverse and remand.

Samuel was convicted upon a trial by jury on two counts of failing to keep his local draft board informed as to his current address and failing to report for induction in violation of 50 U.S.C.App. § 462, and was sentenced on November 21, 1968, to concurrent sentences...
