MESSICK, Judge.

This case is submitted for consideration and determination of defendant's motion to dismiss plaintiff's appeal to this Court from a judgment of the Justice of the Peace Court which was adverse to plaintiff. Defendant's motion is based upon a lack of jurisdiction of this Court to entertain the case, in that the parties to this appeal are not the same as the parties below.
