It is not and cannot be seriously contended that Roberts did not shoot and kill Mrs. Elfriede Howe with a 12-gauge shotgun about three o'clock a. m. on March 11, 1967, in her home in Columbus, Wisconsin. Roberts was an acquaintance of Mrs. Howe, the mother of two children whose husband was in Vietnam.
