McFARLAND, Justice:

Everett Alvin Smith, hereinafter referred to as defendant, was tried — together with Betty Sue Pierce, Theresa E. Baker, and Alfred F. Witt — for the crime of burglary in the first degree. A trial jury found Betty Pierce and Theresa Baker not guilty of the crime; Alfred Witt and defendant were found guilty. The court sentenced defendant to serve a term of not less than ten years nor more than eleven years in the Arizona State Prison...
