On March 6, 1969, the defendant, Patrisk Scrubbs, entered a plea of guilty in this court to an indictment charging him with "uttering a forged check" in violation of Section 2913.01, Revised Code. He was sentenced to the Ohio State Penitentiary at Columbus, Ohio, on the same day, without a presentence investigation, because he had a prior criminal record and neither he nor his attorney requested consideration for probation.
