The parties, with the exception of defendant Finney, concede that the case at bar presents no issues of fact for the court's determination. Defendant Finney, however, contends that a question of fact is presented for this court's determination as to whether or not the option contract between the plaintiff and defendants, Strausser, was properly executed and the consideration therefor properly paid.
