This case was referred to Trial Commissioner Mastin G. White with directions to make findings of fact and recommendation for conclusions of law under the order of reference and Rule 57(a). The commissioner has done so in an opinion and report filed on October 1, 1968. Defendant took no exceptions to the commissioner's findings of fact but opposed adoption of his recommended conclusion of law. Plaintiff took no exception to the commissioner...
