The tortuous history of these cases began on 7 February 1964 when appellee, Federal Savings and Loan Insurance Corporation (Federal), as assignee, sued Quinn on a note in the state court. A confession judgment in Federal's favor, in the amount of $457,702.77, was entered on 11 February 1964. Quinn's state court motion to vacate this judgment was denied on 19 November 1964.
