INZER, Justice.

This is a workmen's compensation case. Claimant James F. Whittington was injured on January 13, 1965, when he stepped into a hole, fell and broke his leg. The commission found that his injury was incidental to and in the scope of his employment and that his intoxication was not the proximate cause of the accident. He was awarded compensation. An appeal was taken to the Circuit Court of Lincoln County where a judgment was entered affirming the order...
