Defendant was convicted by a jury of the offense of breaking and entering with intent to commit larceny.*

Between 3:30 a.m. and 7:00 a.m., June 10, 1965, the "D" bar located in Detroit was broken into, and money, whiskey and cigarettes were taken. Although entry was also made through the basement door, there was testimony indicating that other entrance doors were broken or partially broken. At 3:00 o'clock on the morning...
