Both Baker and Villapando were convicted of possession of heroin. (Health & Saf. Code, § 11500.) Trial was to the court. Pursuant to stipulation the court was permitted to read and consider the transcript of the preliminary hearing. Additional evidence was produced by the defendant Baker.
