This cause has been before us once previously when on November 15, 1963, a suit was instituted by Mrs. Margie Upton in the Circuit Court for the Second Judicial District of Jones County against A.A. Bush, Contractor (hereinafter referred to as Bush), and Bush Construction Company, Inc., the United Gas Company and the City of Laurel, Mississippi, for injuries which she alleged had resulted from her falling into a ditch in Laurel.
