This is an automobile accident case. Joel F. Wells, appellant herein, brought an action against Tanner Brothers Contracting Company (hereafter referred to as Tanner), appellee, to recover damages for personal injuries sustained by him as a result of the alleged negligence of the appellee. A previous trial resulted in a jury verdict of $30,000 for Mr. Wells but the trial court granted a motion for a new trial to Tanner. Mr. Wells did not appeal...
