RUBIN, District Judge:

Is an elected coroner responsible in damages under the Civil Rights Act of 18711 if he signs a commitment certificate stating that he has observed and examined a person and thinks that the person is in need of care and treatment for mental illness when he has not in fact observed or examined him? That is the issue raised by this motion for summary judgment.
