Pittman was convicted on a trial de novo (Code 1940, T. 13, §§ 371 and 372) in the Monroe Circuit Court. The charge against him was as follows:

"The State of Alabama, by its District Attorney complains of H. Clay Pittman that within twelve months before the commencement of this prosecution he did aid encourage, or cause Larry...
