JOHNSON, Judge.

Appellant was indicted in two counts by the Grand Jury of Montgomery County, Alabama, for the offense of burglary and grand larceny. Accompanied by counsel, he was arraigned in open court on November 9, 1965, and entered a plea of not guilty. On November 17, 1965, appellant was found guilty as charged by a jury and sentenced to four years in the penitentiary as punishment therefor.
