The issue is whether or not certain real property to which the plaintiff holds legal title is subject to a leasehold interest of the defendant Shell Oil Company, the lease being dated July 1, 1960. An examination of the record shows that the plaintiff derived his title by a deed to him dated July 16, 1965 from the Manufacturers National Bank of Troy. The bank in turn derived its title from a deed to it dated June 16, 1965 from a Referee appointed...
