OPINION

SWINFORD, Chief Judge.

This action was filed in the Boone County, Kentucky Circuit Court on September 12, 1966. The summons was executed on the defendant on September 15, 1966. On October 7, 1966, the defendant corporation filed its petition for removal to this court. The record is now before the court on the plaintiff's motion to remand the cause to the Boone Circuit Court for further proceedings.
