FROMME, J.:

The defendant, Billie R. Davis, was steward and secretary of the El Dorado Aerie of the Eagles Lodge. He was tried and convicted on three felony counts under K.S.A. 21-915, He was sentenced to the penitentiary on each count for a period of one to five years. The sentences were to run concurrently.

In count one of the information it was charged defendant feloniously set up and kept certain gambling...
