This case was referred to Trial Commissioner Franklin M. Stone with directions to make findings of fact and recommendation for conclusions of law. The commissioner has done so in a report and opinion filed on June 30, 1966, in which the facts are stated in the opinion. Defendant has filed exceptions to the commissioner's report and opinion and the case has been submitted to the court on defendant's brief and oral argument of counsel....
