THOMPSON, Chief Justice.

This appeal is from a conviction of first degree murder and the sentence of death. On March 20, 1965, Mears entered a Safeway store in Sparks, Nevada, and walked to the window of the cashier's booth. He drew a pistol, pointed it at the clerk, and told her to "lay it all right there." The clerk turned and ran toward the manager's office. One shot was fired, narrowly missing her.
