The above entitled cause and its companion case of Rasberry and Clarke Company, Inc. v. Louisiana Department of Highways, La.App., 205 So.2d 449, involve two contracts for highway construction material. Louisiana Paving Company, Inc., (Louisiana Paving) furnished material for the State Project No. 5-08-22, and Rasberry and Clarke Company, Inc. (Rasberry and Clarke) furnished material
