This action was brought under the Federal employers' liability act, section 1, 35 Stat 65 (1908), 45 USC, § 51, for injuries to the plaintiff inflicted in the course of his employment with the Chesapeake & Ohio Railway Company when plaintiff was struck by an automobile driven by the defendant Bryan.
