This cause comes on to be heard upon the motion of plaintiff, appellee herein, to dismiss the appeal and upon the merits of the case.

On July 1, 1966, an affidavit was filed in the Juvenile Court charging defendant, age sixteen, with being a delinquent child in that he killed Eula Ruth Yoss, contrary to Section 2901.01 of the Revised Code.

On July 2, 1966, a hearing was held in the Juvenile Court and defendant was committed to the Ohio Youth...
