ONION, Judge.

This is an appeal from a conviction for Murder with Malice Aforethought based on an indictment charging the appellant with killing Humberto Perez "by stabbing him with a knife." After a verdict of guilty by the jury at the trial which commenced on the 13th day of March, 1967, the appellant requested the judge to assess punishment.
