This is an appeal from a conviction on a charge of having violated the Indiana Uniform Narcotic Drug Act as amended.

Appellant was charged by affidavit reading in pertinent part as follows:

"... that Harry Moore on or about the 30th day of September, A.D. 1963, at and in the County of Marion in the State of Indiana, did then and there unlawfully and feloniously possess and have under his control...
