The defendant, Nick Lopez, was convicted of burglary. He conceded that he entered the home occupied by Rosalie Burres and her husband at 632 Santa Ana Street in Sacramento during the nighttime and without their leave. The only question that remains with respect to the commission of the alleged crime is whether or not the defendant had the intent to commit theft at the time he entered the dwelling house....
