This cause is in this court on appeal on questions of law and fact from a judgment of the Court of Common Pleas of Washington County.

Plaintiff Walker is the owner of lot No. 4 in Holstein Addition to the village (now city) of Belpre. He purchased it on June 26, 1963. Plaintiff Digman is the owner of lot No. 3 in such addition.
