LOCKWOOD, Justice:

Defendant, Rillito Race Track, was indebted to the plaintiffs in the amount of $4,082.00. Under the provisions of A.R.S. § 5-107, the race track had posted with the State Racing Commission a cash deposit in the sum of $5,000.00. The deposit was to insure the payment of certain racing fees. Plaintiffs brought suit against the defendant and the General Insurance Company of America for the amount owed them, and filed a writ of garnishment against...
