This matter is before the court on a motion for judgment on the pleadings filed by the defendant executor herein.

Plaintiffs claim injuries sustained as a result of negligence on the part of defendant's decedent. The petition for damages was filed within two years from the time the injuries were sustained. Plaintiffs did not present claims to the executor of the estate within four months of his appointment and did not petition the Probate Court...
