On August 14, 1963, defendant Kirstein was convicted by a jury of violating CL 1948, § 750.125 (Stat Ann 1962 Rev § 28.320) which makes it illegal for an agent, employee or servant to accept or request a gratuity according to an agreement or understanding to act in some particular manner in relation to his principal's, employer's, or master's business.
