The defendant was charged under Section 2151.41, Revised Code, with acting in a way tending to cause the delinquency of one Kathie Carlson, a minor female, 16 years of age, and was found guilty as charged by a jury on December 8, 1966.

The affidavit, following the usual form, contained the following language: "that on or about the 31st day of December, 1965, to wit: on or about 14th day of January, 1966, in the county of Cuyahoga aforesaid...
