Judgment unanimously reversed on the law, order denying motion to suppress certain evidence reversed, motion granted, and new trial granted.

Memorandum:

Appellants have been convicted following trial of burglary, third degree and grand larceny, second degree. Shortly after 5 o'clock in the morning of March 9, 1964 police officers discovered that a pharmacy in the Town of Cheektowaga had been burglarized. Two safes therein had been broken open and money taken...
