HAMITER, Justice.

Morris W. Munson instituted this suit on three certain promissory notes executed by T. H. Martin, Sr. The defendant Martin answered, and he also reconvened to recover from Munson the sum of $8610.52.

After trial, the district court rendered a judgment for plaintiff on the main action, and it dismissed defendant's reconventional demand.

Martin, thereupon, paid and satisfied plaintiff's claim; but he took an appeal from the judgment...
