In July of 1959, the plaintiff, William E. Kratovil, sued the defendants, Walter A. Thieda and Jean M. Thieda, his wife, on a promissory note payable in installments to bearer, signed by the defendants and Edward D. Herdlicka, and delivered to the plaintiff in July of 1956.
