The facts necessary for this opinion briefly stated are as follows:

On October 19, 1965, a search warrant was issued by a judge of the Common Pleas Court of Stark County, Ohio, to search the residence of the defendant, Mike E. Gennett, at 3037 21st Street, Northwest, Canton, Ohio. This warrant was executed by deputy sheriffs of Stark County and a large amount of gambling equipment, football tickets, tip cards, etc., were found in the house.
