This case was referred to Trial Commissioner Donald E. Lane who, under the order of reference, filed his opinion, findings of fact and recommended conclusions of law on July 1, 1964. Exceptions were filed to the commissioner's findings and recommended conclusions of law by the parties, briefs of the parties were filed and the case has been argued orally.
