This is an appeal taken by the plaintiff from a judgment dismissing his suit for total and permanent disability benefits under the Workmen's Compensation Act.

The 50 year old plaintiff was employed by the defendant as a laborer. His wages were $1.35 per hour. On December 9, 1963 he strained his back while picking up heavy concrete pipe. He continued work but complained of back pain the following day and on December 11 treatment for the back...
