On May 28, 1965, appellee filed a complaint against appellant alleging that she was entitled to one-half or all of the proceeds of a check in the amount of $63,308.16 payable to appellant and appellee, which the appellant had cashed, signing the appellee's name in endorsement. Appellee also originally sued the American Security and Trust Company for wrongfully paying out the proceeds of the check to appellant. That claim was dismissed and...
