LYNCH, Judge:

This action, commenced November 4, 1964, by the plaintiff to recover damages for personal injuries and property damage, allegedly sustained, results from a collision between2 automobiles, one operated by plaintiff and the other by one Helen M. Rush. Helen M. Rush died on March 14, 1964, and Patricia A. Strucker, defendant herein, was appointed as Executrix of her Estate on May 9, 1964.
