The validity of an instrument purporting to lease timber for turpentine purposes is controlling upon this review. Miriam Newton Allen filed a petition against Jack C. Newton, Jr., and W. L. Sparks in the Superior Court of Jenkins County charging the invalidity of the timber lease which they rely upon for the right to work the turpentine on her land.
